EU Platform Work Directive must be transposed by December 2, 2026
The EU Platform Work Directive (2024/2831) requires all member states to implement national laws by December 2, 2026, establishing a legal presumption of employment for platform workers who meet certain criteria. Platforms will need to rebut this presumption to maintain workers as independent contractors.
This has major implications for freelancers and gig workers across Europe. The directive also introduces algorithmic transparency requirements — platforms must disclose how automated systems make decisions about work allocation, pricing, and account restrictions. Spain already has similar legislation (the Riders’ Law), and other countries are at various stages of drafting their transposition laws.
